Terms of Use

The rules for using darwi.org and our newsletter, in plain English.

These Terms of Use ("Terms") govern your use of darwi.org and related newsletters and services (the "Site"), operated by Darwi Media ("Darwi," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. News and education only — not medical advice

Darwi publishes news and educational content about health, genetics, gene editing (including CRISPR) and biotechnology. Nothing on the Site is medical, genetic-counseling, legal or financial advice, and nothing creates a doctor–patient or other professional relationship. Our content is based on cited, published sources and is not reviewed by a clinician. Always talk with a qualified healthcare professional before making health decisions. In an emergency, call 911. 2. Eligibility

The Site is intended for adults in the United States. You must be at least 13 to use the Site and at least 18 (or the age of majority where you live) to buy anything from us. The Site is not directed to children under 13.

3. Accuracy and changes

We work to be accurate, but science changes and errors happen. Content is provided "as is" and may be out of date. We may change, suspend or remove any part of the Site at any time. See our Corrections Policy.

4. Intellectual property

The Site's text, graphics, logos, design and other content are owned by Darwi or its licensors and protected by copyright and trademark law. You may view and share links to our content and quote short excerpts with attribution and a link back. You may not copy, republish, sell, scrape, or use our content to train AI or machine-learning models without our written permission. "Darwi" and related marks are our trademarks.

5. Acceptable use

You agree not to: break the law; infringe others' rights; upload malware; attempt to gain unauthorized access; overload or disrupt the Site; use bots or scrapers without permission; impersonate others; or send spam or abusive messages.

6. User submissions

If you send us comments, tips, corrections, stories or other material, you confirm you have the right to share it and grant Darwi a non-exclusive, worldwide, royalty-free license to use, edit and publish it in connection with the Site. Please do not send sensitive health records or anyone else's personal health information. We may decline or remove any submission.

7. Third-party links, affiliates and sponsors

The Site links to research, companies and other websites we do not control. We are not responsible for their content, products or privacy practices. Some links may be affiliate links, and some content may be sponsored; these are labeled. See our Affiliate Disclosure and Sponsorship & Advertising Policy.

8. Newsletter

If you subscribe, you agree to receive emails from us. You can unsubscribe any time using the link in each email or by emailing admin@darwi.org.

9. Future products and services

We may in the future sell educational kits, courses or services (for example, CRISPR educational kits). Additional terms (pricing, shipping, returns, safety and lawful-use requirements) will apply to those purchases and will be posted on the Site and shown at checkout before anything goes on sale. Educational kits will be intended for lawful educational use only and not for use on humans or animals.

10. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DARWI AND ITS OWNERS, CONTRIBUTORS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY HEALTH OUTCOME, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to defend and indemnify Darwi against claims arising from your misuse of the Site or violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally.

15. Changes to these Terms

We may update these Terms. The "Last updated" date shows the latest version. Continued use after changes means you accept them.

16. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. These Terms, together with the policies linked here, are the entire agreement between you and Darwi about the Site.
